II. General information on data processing
Personal data

Personal data is any information relating to an identified or identifiable natural person (Art. 4 No. 1 of the EU General Data Protection Regulation (GDPR)). This includes data provided when using our website such as address, registration, and telecommunication data. Additionally, data which is automatically compiled when using our website, e.g. your IP address.

Extent of personal data processing

In principle, our website is available for all users without collection of personal data. Personal data will only be obtained, processed and used insofar as doing so is necessary to provide our services and contents to the extent you have requested.

Legal basis for personal data processing

Insofar as we obtain the data subject’s consent to process their personal data, Art. 6, Para. 1, lit. a of the EU General Data Protection Regulation (GDPR) shall apply as the legal basis.

In the event of personal data which is necessary to fulfilling a contract, the contracting party for which is the subject, being processed, Art. 6 Para. 1 lit. b of the GDPR shall apply as the legal basis. This also applies to processing which is required to carry out pre-contractual measures.

Deletion of data and duration of storage

The subject’s personal data shall be deleted or blocked as soon as the purpose of storage ceases to apply. Storage can also take place if this was stipulated by the European or national legislator in Union regulations, legislation or other specifications to which the controller is subject.

Blocking or deletion of the data also takes place if a storage period stipulated by the aforementioned standards elapses, unless the data must be stored for longer to conclude or fulfil a contract.

III. Providing the website and creating log files
Each time our website is accessed, our system automatically records data and information from the accessing computer’s computer system according to Art. 6, Para. 1 lit. f of the GDPR.

The following data is collected in this regard:

(1) Information about the browser type and the version used
(2) The user’s operating system
(3) The user’s Internet service provider
(4) The user’s IP address
(5) Date and time of access
(6) Websites from which the user’s system accessed our website
(7) Websites which are accessed by the user’s system via our website

The data is also stored in our system’s log files. IP addresses of the user or other data which allow data assignment to an individual user are excluded. There will be no storage of this data together with other personal data of the user.

Temporary storage of the IP address by the system is necessary to enable delivery of the website to the user’s computer. The user’s IP address must remain stored for the duration of the session for this purpose.

The data shall be deleted as soon as it is no longer required to achieve the purpose for which it was collected. In the case of data being recorded to provide the website, this is done when the respective session is ended.

Data must be recorded under all circumstances to provide the website and store the data in log files for the purpose of operating the website. As a result, the user has no opportunity to object.

IV. Use of cookies
Our website uses cookies. Cookies are text files which are stored in the user’s Internet browser or on the user’s computer system by the Internet browser according to Art. 6, Para. 1 lit. f of the GDPR. If a user accesses a website, a cookie may be stored on the user’s operating system. This cookie contains a characteristic character string which enables unique identification of the browser the next time the website is called up.

The purpose of using technically necessary cookies is to simplify use of the website for users. Some functions of our website cannot be offered without the use of cookies. To this end, the browser must be recognized even after a page change.

The user data collected by technically necessary cookies is not used to create user profiles.

Cookies are stored on the user’s computer and are transferred by it to us. You as a user therefore have full control over the use of cookies. By changing the settings in your Internet browser, you can deactivate or restrict the transfer of cookies. You can delete cookies that have already been stored at any time. This can also be done automatically. If cookies are deactivated for our website, it may not be possible to use all of the website’s functions in full.

V. Use of Google Analytics
This website uses Google Analytics, a web analytics service provided by Google Inc. (“Google”). Google Analytics uses “cookies”, which are text files that are saved on your computer and enable analysis of your use of this website. The information generated by the cookie about your use of this website is generally transmitted to and stored on a Google server in the United States.

As soon as it is feasibly possible, the IP addresses of the users of this website are truncated and thus anonymised before storing or analysing. The anonymization is made within the European Union or within the European Economic Area. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and truncated there.

On behalf of the operator of this website, Google will use this information to analyse your use of the website to compile reports on the website activities and to provide other services related to website and internet use for the website operator. The IP address which was transferred within the scope of Google Analytics from your browser will not be amalgamated with other dates from Google. You can prevent the storage of cookies by adjusting your browser software; however we advise you that in this case you may not be able to use all of the website’s functions in full.

You can also prevent Google’s collection and processing of the data generated by the cookie and related to your use of the website (including your IP address) by downloading and installing the browser plug-in: Browser Add-On to deactivate Google Analytics.

VI. Contact form and email contact
If you contact us via email or contact form, we store your respective information (mandatory fields of the contact form: name, email address, phone number, reference, free description field) based on Art. 6, Para. 1 lit. a of the GDPR for processing the request as well as for possible follow-up questions. If the email or form contact aims to fulfill a contract, Art. 6, Para. 1 lit. b of the GDPR is the additional legal basis.

Please be advised that messages you submit on our website via email are being transferred unencrypted to us. Please note that these may be read or possibly also falsified by third parties during transport via the worldwide internet. For confidential messages we therefore advise you to send them by regular mail.

At the time of dispatch of the message the following data will also be stored to prevent abuse and to ensure safety of our information technology systems:

(1) The IP user‘s address
(2) Date and time of registration

Data is not disclosed to third parties in this regard. The data is only used for processing the conversation.

The stored data shall be deleted as soon as it is no longer required to achieve the purpose for which it was collected. For the personal data from the contact form’s input screen and the data sent by email, this is the case when the respective conversation with the user has ended. The conversation is ended when the circumstances indicate that the situation concerned has been conclusively clarified. The personal data collected during the contact send process will be automatically deleted.

VII. Links to websites operated by other providers/third parties
Our websites may contain links to other providers’ websites. We would like to point out that this statement of data protection conditions applies exclusively to the websites managed by BPS Forderungsmanagement GmbH. We have no way of influencing the practices of other providers/third parties with respect to data protection, nor do we carry out any checks to ensure that they conform with the relevant legislation.

VIII. Rights of the data subject of access, to correction, block, deletion and revocation
Should you have any questions concerning your data, you can contact us at any time. You have the right to receive on request information about the data stored by us concerning you. Furthermore, you have the right to correction of incorrect data, to block if necessary, and deletion, with the exception of statutory data storage.

As a user you have the opportunity to revoke your consent to the processing of your personal data at any time. You can make changes or the revocation of consent by appropriate report to

We reserve the right to modify this data protection declaration occasionally, so that it always corresponds to the current legal requirements or to implement changes of our services in the data protection declaration. In the event of a following visit the new data protection declaration will apply.
